Agreement to Terms

By accessing or using any mkpl.com Chrome extension ("Services"), including UX Replay, Marketplace Monitor, and Universal Dark Mode, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not use the Services.

Description of Services

We provide browser extensions with different functionalities:

  • UX Replay: Session recording, error tracking, and AI-powered bug reporting
  • Marketplace Monitor: Real-time notifications for marketplace listings
  • Universal Dark Mode: Dark mode for any website

Each extension has specific features detailed in its product page. These Terms apply to all extensions.

User Accounts

Some extensions require accounts, some don't:

  • Universal Dark Mode: No account required, all data stored locally
  • UX Replay & Marketplace Monitor: Account required for server features
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete information when registering
  • You must be at least 13 years old to use our Services
  • You are responsible for all activity under your account
  • One person may not maintain multiple accounts without permission

Acceptable Use

You agree NOT to:

  • Use the Services for any illegal purpose
  • Violate terms of service of third-party websites or platforms
  • Attempt to scrape, harvest, or collect data beyond normal use
  • Use automated scripts or bots to abuse the Services
  • Reverse engineer, decompile, or disassemble our extensions
  • Resell, redistribute, or create derivative works (except as permitted by open source licenses)
  • Send spam or unsolicited messages using data from our Services
  • Attempt to circumvent usage limits or security measures
  • Impersonate others or provide false information
  • Interfere with or disrupt the Services or our servers
  • Record or share session data containing others' personal information without consent (UX Replay)

Usage Limits

Different extensions have different limits:

  • Free Tiers: Generous limits suitable for individual use
  • Pro/Premium Tiers: Higher limits for professional use
  • We reserve the right to modify usage limits with notice
  • Excessive usage may result in rate limiting or account suspension
  • See each extension's pricing page for specific tier limits

Open Source

Many of our extensions are open source under the MIT License. This means:

  • You can view, modify, and fork the source code
  • You can redistribute modifications under the same license
  • You must include the original copyright notice
  • The software is provided "as is" without warranty
  • Check each extension's GitHub repository for specific license terms

Intellectual Property

The Services and their original content, features, and functionality are owned by mkpl.com and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

  • You retain ownership of data you create using our Services
  • Our trademarks and branding may not be used without permission
  • Open source code is subject to its specific license terms

Third-Party Services

Some extensions interact with third-party services:

  • OpenAI API (UX Replay): Subject to OpenAI's terms of service
  • Telegram (Marketplace Monitor): Subject to Telegram's terms
  • Marketplace Websites: You must comply with their terms when using our monitoring
  • We are not responsible for third-party service availability or terms

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MKPL.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

We may terminate or suspend your account and access to the Services:

  • Immediately, without prior notice, for violations of these Terms
  • For prolonged inactivity
  • For any reason at our discretion
  • You may terminate by deleting your account and uninstalling extensions
  • Upon termination, your right to use the Services ceases immediately

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or extension notification. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by the laws of Canada, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Ontario, Canada.

Severability
